1) If you are leasing hunting land, do you need a permission form signed by the land owner to hunt the property?

2) If you are leasing hunting land and bring a guest hunter, does the guest need a signed permission form from the land owner, or just a form signed by you -the hunting lease holder?

Thanks.

I would think that in the first scenario a copy of the lease agreement with your name on it would be sufficient.
Since you are leasing the property and therefore controlling hunter access, you would sign the guest's permission slip.

I agree with where you are coming from but you have to consider that in most hunting leases you are leasing the exclusive hunting rights from the owner. This puts the lease holder in charge. Just like an oil and gas lease; once leased to an oil company it is up to them who drills the well, not the owner. Whoever drills has to follow the original contract stipulations but the original lease company is still responsible for the royalty payment to the landowner. but it doesn't have to be the original lease holder that actually does the work.

In a hunting lease that involves a contract for exclusive hunting permission, the hunting rights are transferred to the lessee making whoever is on the lease the controller of said rights within the stipulations printed in the lease. So that contract is the "permission slip" for the lease holder. a written permission slip would then be needed between the lease holder and the guest in order for the guest to hunt, as long as that guests presence does not violate the original lease agreement.

So in short, the answer lies within the language of the lease agreement.

The lease itself constitutes written permission from the landowner. If the lease contains a provision that permits guests, the lessee could grant written permission to the guest by proxy.
